BAD AUDITION CONTEST—TERMS AND CONDITIONS

1. Instructions on how to enter the Bad Audition Contest 2018 competition (“the Competition”) and details regarding the Competition contained herein form part of these Terms and Conditions. Entry into and participation in this Competition is deemed acceptance of these Terms and Conditions. This Competition is not valid in conjunction with any other offer, competition or promotion by Community Film Project LLC.
2. The Competition is free to enter and open to any person, subject to paragraph 3 below, except Community Film Project LLC staff/cast/crew and their immediate families. The Competition will be void in any other jurisdiction where it is prohibited.
3. Minors are entitled to enter the Competition, provided they have the consent of a parent or guardian to enter and participate in the Competition, and provide that parent or guardian’s details upon entry to the Competition for verification by Community Film Project LLC. Entrants shall be considered as Minors for the purpose of the Competition if they are under the age of 18 years old.
4. The Competition commences on 17 August 2018 (“the Commencement Date”) and closes at 11:59 PM MST on 6 October 2018 (the “Closing Date”) for all categories. The period between the Commencement Date and the Closing Date shall be the Competition entry period (the “Competition Entry Period”).
5. To participate in the Competition, Entrants must create, record and edit in a digital video format your “Bad Audition” of a minimum of 30 seconds and a maximum of 5 minutes (“Short Film”) in duration.
6. The Entrant must own the whole of the copyright in the Short Film. In circumstances where the Short Film or parts thereof are derived from or contain images, sounds or material from an existing work, the Entrants must have obtained written copyright clearance from the owner of that existing work for the use of that existing work which must be produced to Community Film Project LLC on demand. In circumstances where the Short Film or parts thereof contain images of persons, locations, marks, trademarks and any other images which would require permission for their use, the Entrants must have received appropriate written releases for their use which must be produced to Community Film Project LLC on demand. The Entrant shall indemnify Community Film Project LLC in respect of any and all liability arising from any infringement of any rights whatsoever that may arise in respect of the Short Film, and Community Film Project LLC reserves the right to disqualify any Entrant who does not comply with the conditions set out in this clause.
7. The Short Film must not defame any person or entity, or be disparaging to any religion, race, or nation, or contain language that is lewd, obscene or inappropriate, or use any copyrights, images, marks, trademarks or logos for which the Entrant has not obtained permission for their use. Community Film Project LLC reserves the right to disqualify any Entrant who does not comply with the conditions set out in this clause.
8. The Short Film must use the “My Community Film Project end slate”, which will be provided by Community Film Project LLC as a download from the Bad Audition Contest website, as the last shot, for a minimum of ten (10) seconds.
9. The Entrant shall be the one individual person most responsible for the creation, filming, producing and editing of the Short Film.
10. To enter the Competition, after the Commencement Date and prior to the Closing Date, the Entrant must:
a) Use parts of the script from "Before Your Time", available on the Bad Audition Contest webpage.
b) Film yourself performing the most creative worst version of the script imaginable.
c) Download the Community Film Project “Bad Audition” ten (10) second end slate video and attach it to the end of your video.
d) Upload your “Bad Audition” video to your social media channels, use hashtag #beforeyourtimeworstauditionever and attach the link to the form found on the Bad Audition Contest webpage.
e) For Instagram, upload in platform specific segments. Use hashtag and attach our Instagram name #beforeyourtimeworstauditionever
f) For Facebook use the Hashtag and attach our page name #beforeyourtimeworstauditionever
g) For YouTube - Put "Before Your Time Worst Audition Ever" in the title along with your name. Entrants must comply with any applicable rules of YouTube for this purpose.
h) READ the TERMS and CONDITIONS, FILL OUT, and SIGN the PARTICIPANT FORM found on the Bad Audition Contest webpage making sure to add your link to your video.
i) The Entrant shall then receive an email confirming receipt of their entry by Community Film Project LLC, and stating that the acceptance of their entry by Community Film Project LLC is subject to moderation of their entry by Community Film Project LLC in its sole discretion;
j) Community Film Project LLC shall aim to moderate each entry within forty-eight (48) hours of receipt, but moderation may take longer due to the volume of entries from time to time;
k) If the entry is accepted by Community Film Project LLC following moderation, the Entrant shall receive a confirmation email of the acceptance of their entry, and Community Film Project LLC shall provide the Entrant with a link to share their entry on the Bad Audition Contest webpage website for voting purposes; and
l) If the entry is not accepted by Community Film Project LLC following moderation, the Entrant shall receive an email from Community Film Project LLC to the effect that it has not been accepted, the reasons for this, and details for the re-submission of their entry once any defects in their entry have been rectified to the satisfaction of Community Film Project LLC.
m) Entrants must complete all of the steps itemized in paragraphs 11 and 12, to the satisfaction of Community Film Project LLC in its sole discretion, within the Competition Entry Period. Community Film Project LLC will only accept entries made outside the Entry Period at its discretion.
11. By entering the Competition, Entrants acknowledge, agree and declare that they are aware that their participation is entirely at their own risk and that they hereby waive, surrender and relinquish in favor of Community Film Project LLC all claims of any nature and howsoever arising (including as a result of negligence) which but for this waiver, surrender and relinquishment they may or otherwise have against Community Film Project LLC either directly or indirectly arising out of their participation in the Competition.
12. By entering the Competition, Entrants hereby warrant that all information submitted is true, current and complete. Any Entrants who have supplied incomplete, inaccurate or fraudulent information may be automatically disqualified. Community Film Project LLC reserves the right to disqualify any Entrant if Community Film Project LLC has reasonable grounds to believe that an Entrant has breached any of these terms and conditions or has tampered with the Competition process. Failure by Community Film Project LLC to enforce any of its rights at any stage of the Competition does not constitute a waiver of those rights.
13. Incomplete, indecipherable or illegible entries will be deemed invalid. Entrants bear all responsibility to ensure that their entry is complete and legible, and that their Short Film is submitted in the correct format and clearly visible and audible.
14. Entrants are entitled to submit up to three (3) entries and must comply with the entry provisions set out in these terms and conditions. Entrants have discretion to enter different auditions for the same script selection three (3) different ways, or they may choose to enter different three (3) different script selections.
15. The costs of entering the Competition shall be borne solely by the Entrant.
16. The Entrant grants to Community Film Project LLC a nonexclusive, irrevocable license to Community Film Project LLC to publish their Short Film in full on the Community Film Project LLC website and social media platforms/pages and communicate their Short Film to the public in the territory of the world, and in full or in part in any other promotional material of Community Film Project LLC, for the purposes of the Competition.
17. Following the Closing Date, the entries to the Competition shall be judged in the following distinct categories: (a) The Judges’ Choice Category, (b) The Peoples’ Choice Category;
18. One Entrant will be chosen as the winner for each category itemized in paragraph 17 above. The same Entrant may be chosen as winner of both of the categories itemized in paragraph 17 above.
19. The winner of the Judges’ Choice Category shall be determined as follows:
a) A judging panel of industry experts shall be appointed by Community Film Project LLC in its sole discretion;
b) After the Closing Date, Community Film Project LLC shall determine a shortlist of the best Short Films;
c) The judging panel shall view the Short Films on the shortlist determined by Community Film Project LLC;
d) The judging panel shall determine the winner of this category in the judging panel’s sole discretion;
e) The judging shall be based only on the subjective personal opinions of the judging panel and shall be final;
f) Community Film Project LLC accepts no liability for the decisions made by the judging panel, and no correspondence will be entered into in this regard;
g) Community Film Project LLC shall announce the winner of this category within forty-eight (48) hours of the determination of the winner on the Bad Audition Contest webpage, Community Film Project LLC’s Social Media accounts and by email to the winner; and
h) The winner shall be entitled to receive the Judges’ Choice Category Prize Pack.
20. The winner of the People’s Choice Category shall be determined as follows:
a) Any time after the Commencement Date and until (the “Voting End Time”), any person may support their favorite Short Film that has been entered into the Competition by accessing the internet and "Viewing", "Liking", or "Sharing" their favorite Short Film via Social Media. Community Film Project LLC reserves the right to negate support in circumstances where there is in Community Film Project LLC’s opinion any irregularity in the process;
b) The ongoing support registered for each entry shall not be made available by Community Film Project LLC, but the ongoing cumulative ranking of each entry shall be assessed via social media platform analytics;
c) All support will be completed by the end of the Supporting End Time, and no support submitted after the Supporting End Time will be accepted by Community Film Project LLC;
d) The winner of this category shall be the entry with the most support as at Supporting End Time;
e) In circumstances where there are two or more entries that have tied as the most support at the Supporting End Time, Community Film Project LLC shall announce and extend the support for 24 hours (the “Extended Supporting End Time”) for the tied entries only, and the winner shall be the entry with the most support at the Extended Supporting End Time;
f) In circumstances where there are two or more entries that have tied as the most support at the Extended Supporting End Time, Community Film Project LLC shall announce and extend the supporting for successive 24 hour periods thereafter for the tied entries until the winner with the most number of individual support can be determined (the “Further Extended Supporting End Time”);
g) No correspondence will be entered into regarding the Supporting Process;
h) Community Film Project LLC shall announce the winner of this category within 24 hours of the Supporting End Time, the Extended Supporting End Time, or the Further Extended Supporting End Time, as the case may be, on the Bad Audition Contest webpage website, Community Film Project LLC’s Social Media accounts and by email to the winner; and
i) The winner shall be entitled to receive the People’s Choice Category Prize Pack.
21. The Prizes for each category are listed under the Prizes page on the Bad Audition Contest webpage.
22. Community Film Project LLC reserves the right to award further Prizes or Prize Packs to winners, or to alter the content of any Prize Pack in whole or in part at any time, whether by adding or removing Prizes. However, the two cash prizes of one hundred dollars for the top two categories are guaranteed for the winners. Any changes in the Prizes or the content of the Prize Packs shall be notified by Community Film Project LLC from time to time as the case may be.
23. The Prize Packs on offer in the Competition, in full or in part, are non-transferable, non-negotiable, non-refundable, are not redeemable for cash, and are subject to availability.
24. All Prizes in each Prize Pack will be new and in their original packing with their applicable warranty. All electronic prizes will be in United States specification by default.
25. Community Film Project LLC shall make reasonable efforts to deliver the Prize Packs to their respective winners at each winner’s address specified in the Competition Entry Form within six (6) weeks of the announcement of the contest winners. Community Film Project LLC shall not be liable for any delays in delivery of the Prize Packs. All shipping costs for the Prize Packs to the winners’ address shall be paid by Community Film Project LLC. Any duty of other import costs for the Prize Packs shall be paid by the winners. Where the winner in any category is a Minor, the Prize Pack shall be delivered to the parent or guardian nominated by the Entrant.
26. Community Film Project LLC shall not be liable for any tax payable on the value of a Prize Pack in a winner’s country, and any tax payable shall be borne by each winner. Where required by law, Community Film Project LLC shall inform the local taxation authorities of the Prizes received by the winners.
27. Each winner agrees to participate in reasonable post-competition publicity for Community Film Project LLC at Community Film Project LLC’s expense, including but not limited to their attendance for interviews, photographs, videos and any other promotional activity specified by Community Film Project LLC, and grant a nonexclusive, irrevocable license to Community Film Project LLC to use their name, biographical details, photographs, videos, likenesses and any other information regarding the winner deemed appropriate for use by Community Film Project LLC for any promotional and marketing purposes by Community Film Project LLC for a period of one (1) year from the Closing Date.
28. Each Entrant warrants that he or she has no other agreements or arrangements with any third parties relating to the performance, service, image, name or likeness and/or other rights that may interfere with his or her entry into the Competition and the execution of his or her obligations as the winner in this Competition.
29. The terms and conditions of a related third-party supplier or suppliers of prizes may apply and shall be accepted by the winner or winners.
30. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of Community Film Project LLC, Community Film Project LLC reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.
31. Any cost associated with accessing the Competition website is the Entrant's responsibility and is dependent on the Internet service provider used. Community Film Project LLC makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Competition.
32. Except for any liability that cannot be excluded by law, Community Film Project LLC (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under Community Film Project LLC's control); (b) any theft, unauthorized access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Community Film Project LLC) due to any reason beyond the reasonable control of Community Film Project LLC; (d) any variation in the type and specifications of the prizes to that stated in these Terms and Conditions; (e) any prize that has not been received by the claimant after dispatch by Community Film Project LLC; (f) any prize that has been damaged in transit; (g) any tax liability incurred by an Entrant; or (h) use of the prizes.
33. Community Film Project LLC collects personal information of the Entrants in order to conduct the Competition and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required by law, to United States or other regulatory authorities. Entry to the Competition is conditional on providing this personal information, and the Entrant must consent to the use of their personal information for the purposes of the Competition. Community Film Project LLC may, for an indefinite period, and provided that the Entrant has not withdrawn their consent, use the information for promotional, marketing, publicity, research and/or profiling purposes, including sending electronic messages or telephoning the Entrant. The Entrant may opt out of any promotional, marketing, publicity, research and/or profiling conducted by Community Film Project LLC using their personal information at any time by giving Community Film Project LLC notice of their intention to opt out. Entrants should direct any request to access, update or correct information to Community Film Project LLC.
34. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Utah, United States. Entrants agree to submit to the non-exclusive jurisdiction of the courts of the State of Utah, United States. Community Film Project LLC shall comply with any laws applicable in the location where the Competition is held.
35. Community Film Project LLC hereby reserves the right to change, suspend or cancel the Competition, or to change these terms and conditions, by notice on the Community Film Project LLC website. Community Film Project LLC shall not be required to specify any reasons for the changes and shall not incur any liability as a result.
